*Your Consent* By placing an order or reserving a class you agree to our Terms and Conditions. Work will only commence on your cake when your order has been paid. *Prices* All prices are non-negotiable and priced according to your design and size of cake or cupcakes. Lou Orleans Gourmet Cupcakes and Desserts do not ‘price match’, as our prices are based upon our unique work and quality of ingredients used. Following your consultation/inquiry, your quote is valid for 7 days from the quote date. Upfront payment secures this price and prevents any further price increases, except; 1. in exceptional circumstances beyond our control e.g. fuel increase, ingredient cost increase etc. and 2. Alterations made to original quote *Orders* Depending on availability- At least 3 working days’ notice is required for cupcake bouquets and 7-14 days for cakes. It is advisable to book as soon as you know the date you require, particularly for weddings, weekends, summer dates and holidays (Easter, Christmas, etc). Short notice orders will always be considered however, there is no guarantee that there will be availability to fulfill your order and a rush fee of 15% will be applied. Lou Orleans Gourmet Cupcakes and Desserts reserve the right to decline any order. *Deposits and Balance* Your date is not secured until you have paid. Your date will be held for 24 hours following an inquiry, after this time has passed your date will be made available again and will be booked by the first customer to pay for confirmation. Large Event/Wedding Reservations Orders 3-4 months in advance $100 Non refundable holding fee -2 months in advance 50% of order security deposit (order details required) -1 month in advanced full payment *Deposits are applied to your balance* *Payments* Lou Orleans Gourmet Cupcakes and Desserts accepts cash, Cash App, Zelle, Apple Pay and credit/debit cards only. Orders are NON REFUNDABLE You should email us with confirmation of payment transfer in order to facilitate prompt acknowledgement of payment. *Pick Up and Delivery* All baked goods are for pick-up, unless delivery (weddings and large events only) is requested at the time of order. Collection of orders is available from Lou Orleans Gourmet Cupcakes and Desserts via the following hours: Tuesday to Friday 10 am – 6:00pm and Saturdays 9am to 1:00pm. Other times may be available on request but this cannot be guaranteed and arrangements need to be made with at least 7 days’ notice. The customer is responsible for advising Lou Orleans Gourmet Cupcakes and Desserts if they are unable to meet the agreed time for pickup. All orders are made to order, arriving earlier than your expected collection time may result in your cupcake bouquet/cake not being ready and the customer being asked to return at their scheduled appointment. Lou Orleans Gourmet Cupcakes and Desserts does not offer local delivery other than weddings and large orders when arranged. It is your duty to examine the cakes/cupcakes upon collection/delivery to ensure that the order is complete and that the goods have not been damaged in transit. You are required to enter full and accurate details for delivery including the name, address and postcode of the recipient. We will not be responsible for any orders which are not delivered due to incorrect or incomplete information. If there is no one there to receive the delivery at the agreed delivery date and time, then it will be deemed a ‘Failed Delivery’. The item/s will be left in the nearest shaded area, Lou Orleans Gourmet Cupcakes and Desserts will provide a photograph as proof to say that the Cupcake Bouquet/ Cake has arrived and that it is in perfect condition. Lou Orleans Gourmet Cupcakes and Desserts will not be responsible for item/s that become damaged or stolen. We are unable to refund the order cost or delivery charges for failed deliveries. Requests to change delivery/pickup date and time should be given with no less than 7 days’ notice, please note it may not always be possible to accommodate these changes. This excludes rush orders which should be picked up the original collection date. Lou Orleans Gourmet Cupcakes and Desserts advise customers to travel with the cupcake bouquets and cakes on a flat surface, ideally the passenger foot well. The cupcake bouquet/cake may need support either side to stop your cake/cupcake bouquet from tipping over. Lou Orleans Gourmet Cupcakes and Desserts accept no liability for cupcakes/cakes that are damaged on or after collection or delivered to the agreed location. For cupcake/cakes delivered to agreed locations Lou Orleans Gourmet Cupcakes and Desserts will provide a photograph as proof to say that the Cupcake Bouquet has arrived and that it is in perfect condition. Cupcakes and cakes collected are checked by staff and checked by the person on collection. The customer consents that it has been collected in perfect condition by accepting the cake/cupcake bouquet and removing it from the premises. Damages after this point are not Lou Orleans Gourmet Cupcakes and Desserts responsibility. Cupcakes and cakes are fragile and require care and attention when handling, storing and displaying to prevent damage occurring. Please arrive at your pick up time indicated at the time you placed your order. Although we operate as a home bakery, Lou Orleans Gourmet Cupcakes and Desserts accepts no liability that we will be available for late pickup. PLEASE NOTE SATURDAY PICK UPS: We close at 1pm on SATURDAYS, if your order is not picked up by 1pm you will not be able to receive your order until the following Tuesday. (NO EXCEPTIONS) Please arrive at the time you selected during checkout as we ONLY send text/email notifications when your order is ready. *Care* As general guidance, cupcakes/cakes should be eaten as soon as you can, preferably within 1-3 days to maximize freshness. Baked goods should be stored in a cool, dry place and out of direct sunlight. It is recommended to be refrigerated if needed but no more than 24 hours after collection as refrigeration may cause the cupcake to dry out. Cupcakes/cakes should be kept flat at all times and away from strong odors. It is the customer’s responsibility to inform Lou Orleans Gourmet Cupcakes and Desserts if the cupcake bouquet/cake is being consumed the day after collection. Cupcakes/cakes should be stored away from children and animals. It is advisable not to consume cupcakes after three days of date made. Buttercream coloring may stain and care should be taken whilst handling and consuming. *Design conditions* Lou Orleans Gourmet Cupcakes and Desserts aim to produce cakes of highest quality that meet the desires of the clients as we understand them. We do not guarantee an exact replica of any work including our own. Each cupcake/cake is handmade. Whilst every effort is made to ensure consistency in baking, a small amount of variation may occur both in the flavor, color, size, design and texture of the recipe. *Alterations & Changes To Cake* Unfortunately, Lou Orleans Gourmet Cupcakes and Desserts do not offer 'free from' cupcakes as our kitchen is not a certified allergy free workspace. All recipes will contain dairy products, egg and gluten and the client assumes responsibility for advising guests of this fact. Products may contain traces of nuts. GLUTEN SENSITIVE - Gluten sensitive orders are not made with 100% gluten free ingredients, however, we are not a gluten free kitchen. Therefore, it is a possibility for cross contamination with gluten products. *Non-edible Items* Most special occasion cakes contain small proportions of inedible items; it is the client’s responsibility to ensure these are removed by your caterer/guests before consumption. Most of our custom cake toppers contain inedible items and are not suitable for human consumption. Non-edible cake toppers can be purchased at an additional cost. Individual quotes are provided upon request. Lou Orleans Gourmet Cupcakes and Desserts require at least two week’s notice for bespoke cake toppers. *Cancellation* Once your order is placed it becomes NON REFUNDABLE. If cancellations of the order is made 72 hours or more before the order is due for delivery/collection then a 50% deposit is retained and any monies paid above the deposit will be returned in a voucher. If cancellation is made less than 72 hours of the delivery/collection time then all monies received will be retained as preparation of your cupcake bouquet/cake may have started. Any request to cancel within 24 hours of booking and /or cancelled due to failure to read delivery area, calendar availability and/or ordering mistakes will accrue a $10 refund processing fee. In the unlikely event that we are forced to cancel an order through no fault of the customer all monies will be refunded. All cakes remain the property of Lou Orleans Gourmet Cupcakes and Desserts until paid for in full. Lou Orleans Gourmet Cupcakes and Desserts reserve the right to resell any cupcakes/cake that is cancelled. If the customer fails to collect their order at their designated collection time , it is the customer responsibility to contact Lou Orleans Gourmet Cupcakes and Desserts to rearrange collection. If the customer does not contact us within 48 hours, Lou Orleans Gourmet Cupcakes and Desserts will assume the customer no longer requires the cake/cupcake bouquet and it may be given away or resold. It is the customer’s responsibly to inform Lou Orleans Gourmet Cupcakes and Desserts if they’d like the photographs and a special message to be put on social media on a specific date. Photography: Under no circumstance can our work be recorded while collecting orders. Absolutely, no recording in our home bakery. *Complaints* Complaints are very rare but are taken very seriously by Lou Orleans Gourmet Cupcakes and Desserts. Customer satisfaction is our priority. All complaints and/or discrepancies must be reported immediately as some complaints may require further investigation and cupcakes must be returned within 14 hours for inspection, therefore, immediate refund may not be available. · The maximum refund Lou Orleans Gourmet Cupcakes and Desserts offer is the value of the cakes and any delivery charges. · Corrections to cupcakes, including inscription mistakes, can be corrected on the same day in most cases and this is not considered a monetary refund.
