Terms and Conditions BY PLACING AN ORDER, YOU AGREE TO THE BELOW TERMS AND AGREE TO PAY ANY AMOUNTS OWED TO COZY CAKES AS A RESULT OF PLACING YOUR ORDER. •Cottage Food Production Operation: Cozy Cakes is considered a cottage food production operation or home bakery. We are not registered with any health departments and are not under regulation by the state of Texas or any governmental department. Our products are strictly “Home Produced”. •Guarantees and Our Obligation: We make every effort to provide exactly the flavors, fillings, decorations, sizes, shapes, and colors you’ve requested. However, the creation of your product(s) is an art and like any form of art it is subject to variations. We promise to put the utmost care and dedication towards your order. Should an unforeseeable event occur which prevents us from fulfilling our obligation and we must cancel our agreement with you, we will refund you all amounts paid to us and can work with you to find another baker, if you desire. We will fully cooperate to transfer any materials to the new baker and provide your refund within 1 week (7 days). Customer agrees to hold Kimberly McGowen harmless in this instance. •Final payment: The balance of your order, including the cost for any items added after the initial quote/deposit, is due upon delivery of your cake. No rain checks! No exceptions! You agree to pay all amounts incurred as a result of you requests. The amount(s) provided to you represent the minimum amount due at the time your order is placed. •Our products can contain major food allergens, such as eggs, nuts, soy, peanuts, milk or wheat. It is the Customer’s responsibility to notify Cozy Cakes of any ingredients that should not be used within the products ordered. Customer agrees to hold Kimberly McGowen harmless for any allergic reactions associated with the consumption of the requested products. •Cancellations: We strongly discourage cancellations, but will accept cancellations up to 2 weeks (14 days) prior to the event. Your deposit(s) will be refunded to you in full within 30 days. Cancellations within the final 2 weeks leading up to your event will result in a forfeiture of your “Save the Date” deposit. Any items provided to us by you will be returned to you within 1 week (7 days). •Legal. To the fullest extent permitted by law, and not withstanding any other provision of this Agreement, the total liability in the aggregate, of Kimberly McGowen and any employees and/or subcontractors, to the Customer, and anyone claiming by or through the Customer, for any and all claims, losses, costs or damages, including attorneys’ fees and costs and expert- witness fees and costs of any nature whatsoever or claims expenses resulting from or in any way related to this contract from any cause or causes shall not exceed the total compensation received by Kimberly McGowen for services from said Customer.
