Your initial deposit, fifty percent (50%) of the order, reserves your event date and is non-refundable, unless you cancel in writing thirty (30) days prior to the event. If you notify us of a cancellation thirty (30) days prior to the event, we will refund half of your deposit. No refunds of the deposit will be given if you cancel your order less than thirty (30) days prior to the event. However, we appreciate you giving as much notice as possible and if we are able to re-book your date (subject to availability), we will apply half of the amount of your un-refunded deposit to a future event. We must receive the balance by the due date indicated or contract is null and void, and deposit will not be refunded. The date of your final payment is the final date for any changes of size, style or flavors of the cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges. Delivery and setup is depending on the location of the venue and will be stipulated in the final price. We are not responsible for any damage to the cake/dessert after setup is complete. You are responsible for providing an appropriate and secure table and environment for the cake(s)/dessert. Cakes are heavy and require a sturdy table, and optimal room temperature of 72 degrees Fahrenheit or below. Buttercream melts in heat and sunlight. If flowers are provided by an outside source, we will place them for an additional fee. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. You are responsible for making sure all non-edible items (fresh flowers, silk flowers, ribbons, rhinestones, brooches, dowels, wires, toppers, etc.) you have requested on your cake as decoration are removed from the cake before it is cut and served. When choosing a topper, please take into consideration its weight, balance, and the fact that it will be sitting on top of a soft cake. We will not be responsible for any damages to the cake or the topper should it fall off the cake or sinks into it. It is possible that your cake has wooden dowels, straws, cake boards, etc inside of it for support. You agree to remove all supplies used for support before serving. You acknowledge that it is not ever safe to throw a cake at someone, smash their face into the cake, sit on a cake, etc. If you or your representative elects to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves our possession. Cakes require a flat surface at all times. On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you. By law, copyrighted images, logos, characters, cartoons, designs, etc. need permission from the copyright holder to be reproduced. You agree that you have authorized use of your chosen design for your order. Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions. Performance of this agreement is contingent upon our ability to complete the Agreement and is subject to labour disputes or strikes, accidents, Acts of God, pandemics, and other causes beyond our control.
